VETERINARY SERVICES ACT (CAP. 437)
Food Hygiene and Health Conditions for the Production and Placing on the Market of Certain Products of Animal Origin intended for Human Consumption
(Amendments and Repeals) Rules, 2006
IN exercise of the powers conferred by article 10 of the Veterinary Services Act, the Minister for Rural Affairs and the Environment has made the following rules>

l. The title of these rules is the Food Hygiene and Health Conditions for the Production and Placing on the Market of Certain Products of Animal Origin intended for Human Consumption (Amendments and Repeals) Rules, 2006.
2. (1) The scope of these rules is to transpose the provisions found in Directive 2004#41#EC of the European Parliament and of the Council of 21 April 2004 repealing certain directives concerning food hygiene and health conditions for the production and placing on the market of certain products of animal origin intended for human consumption, and amending Council Directives 89#662#EEC and
92#118#EEC and Council Decision 95#408#EC, hereinafter referred to as “the Directive”.
(2) The said Directive 89#662#EEC applies only insofar as it has been transposed into the Veterinary Checks Applicable in Intra- Community Trade with Member States in Animal Products Regulations,
2003.
3. The Veterinary Checks Applicable in Intra-Community Trade with Member States in Animal Products Regulations, 2003 shall be amended as follows>
(a) in sub-regulation (3) of regulation 1 thereof, for the words “products of animal origin which are covered by the European Union Directives listed in the first schedule”, there shall be substituted the words “products of animal origin which are covered by the Directives listed in Schedule A”<
(b) in paragraph (a) of sub-regulation (1) of regulation 4, for the words “products obtained in accordance with the legislation referred to in Schedule A”, there shall be substituted the words
“products of animal origin covered by the acts referred to in
Schedule A”< and
(c) for Schedule A thereof, there shall be substituted the following>
“SCHEDULE A
CHAPTER I
(a) Animal Health (Production, Processing, Distribution and Introduction of Products for Human Consumption) Rules, 2005 (L.N. 145 of 2005

).
(b) Regulation (EC) No 853#2004 of the European Parliament and of the Council of 29th April, 2004 laying down specific hygiene rules for food of animal origin.
CHAPTER II
(a) Council Directive 92#118#EEC of the 17th December,
1992 laying down animal health and public health requirements governing trade in and imports into the Community of products not subject to the said requirements laid down in specific Community rules referred to in Annex A, Chapter I to Directive
89#662#EEC and, as regards pathogens, to Directive 90#425#EEC.
(b) Regulation (EC) No 1774#2002 of the European Parliament and of the Council of the 3rd October, 2002 laying down health rules concerning animal by-products not intended for human consumption.”.
4. The animal health rules laid down in the Health and Veterinary Inspection Problems upon Importation of Bovine Animals, Swine and Fresh Meat from Third Countries Rules, 2005 shall continue to apply only to the importation of live animals.
5. The following regulations are hereby being repealed>-
(a) Fresh Meat (Bovine, Swine, Sheep, Goats and Domestic Solipeds) for Human Consumption Regulations, 2004 (L.N. 120 of 2004
