(1) No claim to recover a qualified right to payment from the proceeds of a suitable guarantee shall be made to the Controller under regulation 26 after the Controller has returned the suitable guarantee to the certification authority under regulation 24.

(2) Nothing in subregulation (1) shall be construed as limiting the rights of the claimant to recover a qualified right to payment from the certification authority concerned in execution of the judgment of the court by any other means.
