DETAILS OF BROADCAST




TERMS OF CONDITIONS


1. This contract is subject to the Department of Broadcasting's Programme Code, the Advertising Division's Advertising Code and any regulations made under the Telecommunications Act 1950 relating to Radiocommunication Advertising.

2. The Department of Broadcasting may refuse to broadcast any advertising matter or programme material submitted by the advertiser, and may determine this contract, or advance or retard in point of time, or postpone, the braodcasting of such matter or material without assigning any reason, notwithstanding -

(i) the acceptance of payment or part payment of the assessed charge; or

(ii) that such matter or material has been in part broadcast, or that some instalments or items thereof have been broadcast; and in such event the Advertising Division shall not be liable to refund more than the charge for the unused broadcast time.

3. This contract is made subject to non-liability on the part of the Government for interference by accident, breakdown of machinery, failure of power, fire, failure of artists to appear, strikes, weather conditions and other frustrations.

4. The purchaser warrants that the advertising and programme material submitted for broadcasting.-


(i) contains no false or unwarranted claims for any product of service and contains no defamatory statements; and

(ii) does not infringe the copyright or other right of any person;

and the purchaser will keep the Government and any officer of the Ministry of Information indemnified against all claims, actions, suits, demands, losses, cost and expenses in respect of the broadcast matter.

5. The playing rights in a transcribed programme hired for any broadcast are limited to one performance only, unless otherwise agreed, and special rates charged, and no property in them shall pass on to the purchaser. If a transcribed programme is supplied by the purchaser, he shall deliver it to the Advertising Division, free of cost, and prepay return mailing charges. The Government shall not be liable for any loss or damage to a transcribed programme while it is under the control of the Advertising Division.

6. The Ministry of Information is at liberty to increase the rate for such broadcasting and the rate of the programme fee at any time during the duration of this contract on being advised by three months notice in writing of such proposed increase and thereafter such increased rate or rates shall be deemed to form part of this contract.

7. The purchaser shall pay for such broadcasting under this contract within thirty days from the date of billing.
