(1) Any person who contravenes the provisions of subsection (1) of section 2, subsection (5) of section 3, subsection (2) of section 15, subsection (2) of section 16, subsection (1) of section 17, subsection (2) of section 33, subsection (2) of section 41, subsections (9) and (10) of section 47 and section 77 of this Act or any rule or regulation mark thereunder, and the licensed commercial bank and every officer or servant of such bank who knowingly and willfully authorizes or permits such default, shall be guilty of an offence under this Act and shall be liable, on conviction after summary trial before a Magistrate, to imprisonment of either description for a term not exceeding ' three years or to a fine not exceeding one million rupees or to both such imprisonment and such fine. |

(2) Every person who is guilty of an offence under this Act for which no punishment has been specified under subsection (1), shall, after summary trial before Magistrate, be liable to imprisonment for a term not exceeding eighteen months or to a fine not exceeding five hundred thousand rupees or to both such imprisonment and such fine. |
