Court may issue commission for taking evidence of absent witness
409. Whenever in the course of an inquiry, trial or other , proceeding under this Code it appears to the court that the examination of a witness is necessary for the ends of justice and that the attendance of such witnesses cannot be procured without an amount of delay, expense, or inconvenience which under the circumstances of the case would be unreasonable, such court may dispense with such attendance and may after notice to the parties issue a commission to a court of like or inferior jurisdiction within the local limits of whose jurisdiction such witness resides to take the evidence of such witness. |
