| (1) The court to which the commission is issued shall on receiving the commission summon before it the witness named in the commission.; or if from ill health or other cause his attendance cannot reasonably be procured the Judge shall proceed to the place where the witness is. |

| (2) The evidence of the witness shall be taken down by the Judge in the same manner and such Judge may for the purpose exercise the same powers as a Magistrate holding inquiries under this Code. |
