Power to increase, without public inquiry, maximum fares by a fares scheme

79.
(1) Where the maximum fares fixed by any fares scheme or fares schemes in force in respect of the omnibus services provided by the Ceylon Transport Board are inadequate to meet the costs of providing such services by reason of an increase in such costs and the Ceylon Transport Board will be unable to perform its general duty under paragraph (b) of subsection (1) of section 5 unless such maximum fares are immediately increased, the fares board may, upon application made in that behalf by the Ceylon Transport Board with the approval of the Minister, increase such maximum fares; and the provisions of section 77 which require that the application and a notice specifying the time and manner in which objections and representations may be made with respect to the application shall be published and that a public inquiry into the application shall be held shall not apply in relation to an application made by the Ceylon Transport Board under this subsection.
(2) Where the maximum fares referred to in subsection (1) are increased by the fares board upon an application made in that behalf by the Ceylon Transport Board under that subsection, the provision in the proviso to subsection (1) of section 77 that the fares board shall not entertain an application for the alteration of any fares scheme if less than twelve months have elapsed since the coming into force of such scheme shall not apply in relation to an application for the alteration of such maximum fares as so increased.
