(1) If any person, without the consent of the appropriate authority, uses in connection with any trade, business, calling or profession the mark, seal, emblem or device (or any mark, seal, emblem or device so closely resembling such mark, seal, emblem or device as to be calculated to deceive) of any organization, institution or corporation, in which the Government of Ceylon has an interest and to which this subsection applies, he shall be guilty of an offence and shall be liable on summary conviction to a fine not exceeding one hundred rupees. |

(2) Subsection (1) shall apply to every mark, seal, emblem or device specified in that behalf by Order made by the Minister and published in the Gazette. |

(3) The Minister shall in every such Order specify the officer or person who shall be the authority competent to give the consent referred to in subsection (1). |

(4) Nothing in this section shall be construed as affecting the right, if any, of the proprietor of a trade mark containing any such mark, seal, emblem or device to continue to use such trade mark. |
