Enhancing the Punishment of Fines Prescribed in Various Statutes
Various Federal Statutes enacted since 1850 define offences and prescribe punishments thereof. The punishments are in the shape of imprisonment, fine or both. The object of punishment is to prevent the repetition of commission of offences and serve as deterrent to would-be offenders. The fines in various statutes were fixed long ago. Some were revised but most have remained unchanged. Due to the passage of time and devaluation of currency, the fines have seemingly lost their impact and are no longer serving the purpose of deterrence. These fines therefore need to be reviewed with a view to appropriately enhance them. It may further be noted that certain offences which were not considered serious in the past, have now assumed a grievous character and are on the increase, particularly because the penalties prescribed in the statutes do not operate as an effective check and deterrence on the offenders. Laws need to be changed from time to time, with a view to keep them relevant and be able to address the changed conditions in the society. In this regard, the Secretariat has carried out a thorough review of the Federal statutes with a view to rationalise by enhancing the amounts of fines prescribed therein. The Commission may approve the enhancement of fines in various statutes mentioned below as per given formula:
(a) Statutes from 1851 to 1900 – 5 fold increase in amount of fine.
(b) Statutes from 1900 to 1950 – 4 fold increase in amount of fine.
(c) Statutes from 1950 to 1975 – 3 fold increase in amount of fine.
(d) Statutes from 1975 to 1995 – 2 fold increase in amount of fine.
It may be noted that no increase has been suggested in fines in statutes which were amended or enacted since 1995.
In the light of above formula, the proposed enhancement of fine in the statutes is given as under:

The above working paper was considered by the Commission in its meeting held on 11-12-04.
The Secretary informed that in an earlier meeting, the Commission had asked him to examine the sums of fines, fixed in old statutes, to consider as to how far they are relevant to the present-day realities. The draft accordingly lists all such Federal statutes, he stated. He explained that whereas some of statutes have been amended, from time to time, others have remained unchanged; and as a result, with the passage of time and devaluation of currency, the amounts specified therein have become inadequate, thereby the penalty having lost its deterrent effect. The Commission deliberated upon the proposal and resolved that besides enhancing the penalty, the statutes need to be carefully examined once more, with a view to see the efficacy and rationale of some, which perhaps are no longer relevant or needed. The Secretary should therefore again review the list in this perspective. The Commission further observed that rather than enhancing the penalties, from time to time, and amending each and every statute, the Secretariat should see as to whether such amount can be indexed to the rate of inflation by linking it with the rate of silver, as is the case in payment of Diyat, under the Qisas and Diyat law. The Commission asked the Secretary to consult the Attorney General for Pakistan in the matter and submit report in the next meeting.
On the above direction of the Commission, the matter was referred to the Attorney General for Pakistan.

The proposal for enhancement of fine prescribed in various statutes was again considered in the Commission meeting held on 19-3-2005.
The Chairman said that in this paper, the Secretariat have carried out a comprehensive review of a large number of statutes, wherein the penalty of fine was fixed long ago, but the sums have not been increased in keeping with the devaluation of currency and rate of inflation. The object of punishment of fine is to prevent the repetition of commission of offences and serve as deterrent to would-be offenders. The fines in various Federal Acts were fixed long ago. Some were revised but most have remained unchanged. Due to the passage of time and devaluation of currency, the fines have seemingly lost their impact and are no longer serving the purpose of deterrence. These fines therefore need to be reviewed with a view to appropriately enhance them. It may further be noted that certain offences which were not considered serious in the past, have now assumed a grievous character, and are on the increase, particularly because the penalties prescribed in the statutes do not operate as an effective check on the offenders. Laws need to be changed from time to time, with a view to keep them relevant and be able to address the changed conditions in the society. The Commission therefore recommended the enhancement of fines in various Federal Acts, in existence since 1850. The increase should be as per following formula:
1. Statutes made form 1850 to 1900 - 5 fold increase in amount of fine should be effected.
2. Statutes made from 1901 to 1950 - 4 fold increase in amount of fine should be effected.
3. Statutes made from 1951 to 1975 - 3 fold increase in amount of fine should be effected.
4. Statutes made from 1976 to 1995 - 2 fold increase in amount of fine should be effected.
No increase has been suggested in fines in those statutes which were amended in the past, from time to time, or new statutes, enacted since 1995.
